Welcome to Oktoberfest Lederhosen. These Terms & Conditions ("Terms") govern your use of our website and any purchase you make from us. By placing an order or browsing our store, you agree to be bound by these Terms. If you do not agree, please do not use this website.
1. WHO WE ARE
Oktoberfest Lederhosen is based in Lahore, Pakistan, and sells handcrafted Bavarian leather apparel, including lederhosen, shirts, accessories, and personalized items, shipped worldwide from our workshop. For any questions or complaints, please contact us through our Contact page.
2. ELIGIBILITY
You must be at least 18 years old, or purchasing under the supervision of a parent or guardian, to place an order with us.
3. PRODUCTS & DESCRIPTIONS
We make every effort to accurately display our products, including colors, materials, sizing, and price. Because our goods are genuine leather and handcrafted, slight natural variations in grain, color, and finish between the product you receive and the photos shown are normal and not considered defects. Prices and availability are subject to change without notice prior to order confirmation.
4. PRICING & PAYMENT
All prices are shown in the currency displayed at checkout. Payment is processed securely through our third-party payment gateways at the time of order; we do not store your full payment card details on our servers. Depending on your destination, additional taxes, duties, or customs charges may apply on delivery, as described in our US Duties & Tax page and, for other regions, by your local customs authority.
5. CUSTOM & PERSONALIZED ORDERS
Items that are custom-made or personalized (such as name or initial embossing) are produced specifically for you and typically require 2-3 weeks for production, as detailed on our Shipping & Delivery page. Because of their personalized nature, these items cannot be returned or exchanged unless they arrive defective or damaged, or unless applicable law gives you a non-excludable right to cancel before production begins. Please double-check names, initials, and sizing before submitting a custom order.
6. ORDER ACCEPTANCE & CANCELLATION
We reserve the right to refuse or cancel any order, including for reasons such as product or pricing errors, suspected fraud, or unavailable inventory. If we cancel an order after payment has been taken, you will receive a full refund.
7. SHIPPING & DELIVERY
Order processing times, shipping rates, delivery estimates, and customs information are detailed on our Shipping & Delivery and US Duties & Tax pages, which form part of these Terms. For international orders, any customs duties, tariffs, or import taxes are the responsibility of the customer unless we state otherwise at checkout.
8. RETURNS, EXCHANGES & REFUNDS
Standard, non-personalized items may be returned within 7 days of delivery, subject to the conditions on our Shipping & Delivery page (unworn, unwashed, with original tags and packaging intact). A 20% restocking fee applies to refund requests, and is waived when exchanging for a different size or color. Custom and personalized items are final sale except in the case of a manufacturing defect.
Where the law of your country of residence guarantees a longer minimum return or withdrawal period than stated above, that longer legal minimum applies to your order instead, to the extent required by that law (see Section 9 for EU/UK consumers specifically).
9. RIGHT OF WITHDRAWAL FOR EU/UK CONSUMERS
If you are a consumer ordering from the European Union or the United Kingdom, you have the right to withdraw from your purchase within 14 calendar days of receiving your order, without giving any reason, in accordance with the EU Consumer Rights Directive (2011/83/EU) and the UK Consumer Contracts Regulations 2013.
To exercise this right, notify us within the 14-day period via our Contact page. You must then return the goods to us within 14 days of that notice, unused and in their original condition. We will refund your payment, including standard delivery costs, within 14 days of receiving the returned goods or evidence that you have sent them back, using the same payment method you used to pay, unless agreed otherwise. You are responsible for the direct cost of returning the goods.
This right of withdrawal does not apply to goods made to your specifications or clearly personalized (see Section 5), except where such goods arrive defective.
10. YOUR STATUTORY RIGHTS
Nothing in these Terms limits or excludes any consumer protection, warranty, or other right that cannot lawfully be limited or excluded under the law of your country of residence, including (without limitation) statutory guarantees under the Australian Consumer Law, implied terms under the UK Consumer Rights Act 2015, and equivalent protections under EU member state law. Where any part of these Terms conflicts with such a mandatory right, your statutory right takes precedence.
11. INTELLECTUAL PROPERTY
All content on this website, including text, graphics, logos, product photography, and designs, is the property of Oktoberfest Lederhosen or its licensors and may not be copied, reproduced, or used without our prior written permission.
12. ACCEPTABLE USE
You agree not to misuse this website, including attempting to gain unauthorized access to our systems, interfering with the site's normal operation, or using the site for any unlawful purpose.
13. DATA PROTECTION
Your personal data is collected and processed in accordance with our Privacy Policy, which is designed to meet applicable data protection laws including the EU/UK General Data Protection Regulation (GDPR) and other regional frameworks referenced there.
14. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Oktoberfest Lederhosen is not liable for any indirect, incidental, or consequential damages arising from your use of this website or your purchase of our products. Our total liability for any claim relating to an order is limited to the amount you paid for that order. Nothing in this section limits liability that cannot be limited under applicable law, including liability for death, personal injury, or fraud.
15. DISPUTE RESOLUTION
If you have a concern, please contact us first through our Contact page so we can try to resolve it directly. If you are an EU consumer, you may also submit a complaint via the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr. Using this platform does not affect your right to bring a claim through the courts.
16. GOVERNING LAW
These Terms are governed by the laws of Pakistan, without prejudice to any mandatory consumer protection law of your country of residence that applies regardless of choice of law, which continues to apply to the extent it grants you rights these Terms cannot override.
17. SEVERABILITY
If any provision of these Terms is found unenforceable in a particular jurisdiction, that provision will be limited or removed to the minimum extent necessary in that jurisdiction, and the remaining provisions will stay in full effect.
18. CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes in our practices or for legal reasons. The updated version will be posted on this page with a revised effective date, and continued use of the site after changes take effect constitutes acceptance of the revised Terms.
